GentlePath360 Website Terms and Conditions

These Website Terms and Conditions (“Terms”) govern your access to and use of www.gentlepath360.com and any related webpages, forms, resources, and online features operated by GentlePath (“GentlePath,” “we,” “us,” or “our”).
By accessing or using this website, you acknowledge that you have read, understood, and agreed to these Terms and our Privacy Policy. If you do not agree, please do not use the website.
1. About GentlePath
GentlePath is an independent logistics coordination and family advocacy service that assists families with organizing funeral, cremation, burial, memorial, and related arrangements.
GentlePath does not replace funeral homes, cemeteries, crematories, healthcare providers, clergy, attorneys, financial advisers, mental-health professionals, or other licensed service providers.
GentlePath is not a funeral establishment and does not directly provide embalming, cremation, burial, transportation of human remains, medical treatment, legal representation, financial advice, or other regulated professional services unless expressly stated and legally authorized.
2. Website Information
The information and resources available through this website are provided for general informational and educational purposes. Website content is not a substitute for professional legal, medical, financial, tax, estate-planning, mental-health, grief-counseling, or funeral-directing advice.
Although GentlePath seeks to provide helpful and accurate information, we do not guarantee that all website content is complete, current, error-free, or appropriate for every family or circumstance.
You should verify important requirements, deadlines, prices, provider qualifications, and legal obligations with the appropriate licensed provider or government authority.
3. No Emergency Services
The website is not an emergency-response service and should not be used to request police, fire, medical, crisis, or other emergency assistance.
If you are experiencing an emergency, call 911 or the appropriate local emergency authority immediately.
Submitting a website form, email, voicemail, or text message does not guarantee an immediate response from GentlePath. Same-day or expedited coordination is available only when expressly accepted and confirmed by GentlePath.
4. Eligibility and Authority
You must be at least 18 years old and legally capable of entering into an agreement to purchase GentlePath services.
When providing information or instructions concerning another person, including a deceased individual, family member, or authorized representative, you represent that:
The information is accurate to the best of your knowledge;
You are authorized to provide it;
Providing it does not violate another person’s rights; and
GentlePath may reasonably rely upon it for the requested purpose.
GentlePath may request identification, authorization, or supporting documentation before releasing confidential information or acting upon instructions.
5. Website Use Does Not Create a Client Relationship
Visiting the website, submitting an inquiry, completing an intake form, or receiving general information does not by itself establish a client or service relationship with GentlePath.
A service relationship begins only after GentlePath accepts the engagement and any required service agreement, authorization, and payment arrangements have been completed.
If these Terms conflict with a signed GentlePath service agreement concerning paid coordination services, the signed service agreement will control for those services.
6. Scope of Coordination Services
When formally engaged, GentlePath may assist with activities such as:
Organizing family preferences and instructions;
Coordinating communications among family members and selected providers;
Tracking appointments, schedules, documents, and deadlines;
Reviewing available pricing information;
Researching providers and service options;
Assisting with memorial, reception, transportation, travel, or related logistics; and
Advocating for the family’s stated wishes and budget considerations.
The exact scope, fee, limitations, and duration of services will be described in the applicable service agreement.
7. Family Decisions and Provider Relationships
Families retain final authority over funeral, cremation, burial, memorial, financial, and provider-selection decisions.
Unless expressly agreed otherwise:
Families contract directly with funeral homes and other providers;
Families are responsible for reviewing and approving provider agreements;
Families are responsible for paying third-party providers;
GentlePath does not guarantee the conduct or performance of a provider; and
GentlePath is not a party to agreements between a family and a third-party provider.
GentlePath may communicate family instructions to providers, but it cannot compel a provider to accept an engagement, change its policies, reduce its prices, or perform a particular service.
8. Vendor Neutrality and Recommendations
GentlePath is committed to providing independent coordination and family advocacy. Provider information or recommendations may be based on availability, location, family preferences, pricing, experience, publicly available information, or other relevant considerations.
A provider’s inclusion on the website or in a recommendation does not constitute a guarantee, certification, warranty, or endorsement of that provider’s work.
Families are encouraged to conduct their own review before hiring any provider. Any financial relationship that could reasonably affect a provider recommendation will be disclosed when applicable.
9. Pricing and Savings Information
Prices displayed on the website are subject to change unless otherwise stated in a signed service agreement.
Third-party prices, estimates, and availability may change without notice and remain subject to the applicable provider’s terms. GentlePath does not control third-party pricing.
Any potential savings, price comparisons, negotiation results, or financial examples are estimates or illustrations unless expressly documented otherwise. GentlePath does not guarantee that a family will obtain a particular price, discount, refund, or amount of savings.
10. Payments, Cancellations, and Refunds
Fees, payment schedules, cancellation rights, and refund terms for GentlePath services will be disclosed before purchase or stated in the applicable service agreement.
Payments may be processed by an independent payment provider and may be subject to that provider’s terms and privacy practices.
GentlePath will not enroll a client in an automatically renewing paid service without presenting the material terms and obtaining any authorization required by applicable law.
11. Electronic Communications and Signatures
By submitting your contact information, you authorize GentlePath to respond using the email address or telephone number you provide.
If you separately consent to receive text messages, message and data rates may apply. Consent to receive promotional text messages is not a condition of purchasing services. Instructions for opting out will be provided where applicable.
You agree that electronic communications, records, acknowledgments, and signatures may be used in connection with the website and GentlePath services to the extent permitted by law.
12. Privacy
GentlePath’s collection, use, retention, and disclosure of personal information are described in our Privacy Policy, which is incorporated into these Terms by reference.
Because funeral planning may involve sensitive information, users should avoid submitting Social Security numbers, complete financial-account credentials, medical records, or other highly sensitive information unless GentlePath specifically requests it through an appropriate method.
13. Acceptable Use
You agree not to:
Use the website for unlawful, fraudulent, abusive, or deceptive purposes;
Submit false, misleading, defamatory, or unauthorized information;
Impersonate another person or misrepresent your authority;
Attempt to gain unauthorized access to the website, accounts, systems, or data;

Accessing a third-party website or hiring a provider is at your discretion and subject to that third party’s terms.

GentlePath may modify, suspend, restrict, or discontinue any website feature at any time. We do not guarantee that the website will always be available, uninterrupted, secure, or free from errors or harmful components.
We may perform maintenance, install updates, correct errors, or change website content without advance notice.
18. Disclaimer of Warranties

GENTLEPATH DOES NOT WARRANT OR GUARANTEE ANY PARTICULAR PROVIDER, PRICE, SAVINGS, OUTCOME, RESPONSE TIME, OR RESULT.
Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.
19. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GENTLEPATH AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, ADVISERS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE WEBSITE.
GENTLEPATH IS NOT RESPONSIBLE FOR THE INDEPENDENT ACTS, OMISSIONS, DELAYS, PRICES, REPRESENTATIONS, OR SERVICES OF THIRD-PARTY PROVIDERS.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability to the extent caused by fraud, willful misconduct, gross negligence, or another legally non-waivable act.
Additional limitations applicable to paid coordination services may be included in the applicable service agreement.
20. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold GentlePath and its owners, officers, employees, contractors, advisers, and agents harmless from third-party claims, liabilities, damages, losses, and reasonable expenses arising from:
Your unlawful or unauthorized use of the website;
Information you submit without proper authorization;
Your material violation of these Terms; or
Your infringement of another person’s rights.
This provision does not require you to indemnify GentlePath for its own fraud, willful misconduct, gross negligence, or other liability that cannot lawfully be shifted.
21. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Any legal proceeding concerning these Terms or the website must be brought in a court of competent jurisdiction located in Palm Beach County, Florida, unless applicable law requires otherwise.
Before filing a legal claim, you and GentlePath agree to make a reasonable good-faith effort to resolve the dispute informally by providing written notice describing the issue and requested resolution.
22. Changes to These Terms
GentlePath may update these Terms to reflect changes in our website, services, operations, or legal obligations.
Updated Terms will be posted on this page with a revised effective date. Changes will apply prospectively unless applicable law permits otherwise.
Your continued use of the website after updated Terms become effective constitutes acceptance of those Terms. Material changes affecting an existing paid service will be handled in accordance with the applicable service agreement and law.
23. Termination
GentlePath may suspend or terminate website access for misuse, fraud, security concerns, unlawful conduct, or a material violation of these Terms.
Provisions that by their nature should survive termination—including intellectual-property rights, disclaimers, limitations of liability, indemnification, and dispute provisions—will remain effective.
24. General Provisions
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
A failure by GentlePath to enforce a provision does not waive the right to enforce it later.
These Terms, together with the Privacy Policy and any applicable service agreement, constitute the relevant agreement between you and GentlePath concerning the subject matter they address.
You may not transfer your rights under these Terms without GentlePath’s written consent. GentlePath may transfer its rights and obligations as part of a merger, restructuring, sale, or other lawful business transaction.
